Legal framework

The legal purchase process in Spain.

When buying property abroad we follow a clearly defined legal process. Thanks to the public-notary institute, Spanish law provides buyers with absolute security.

Reservation contract

The property is taken off the market. A reservation fee (typically 10%) is paid and the purchase price is fixed for the time required to complete all audits.

Preparation (NIE & bank)

Obtaining the mandatory foreigner ID number (NIE) and opening a Spanish bank account from which the property will be paid.

Notarial Escritura

Final signing of the purchase contract exclusively before a Spanish notary. This is also where the guaranteed bank cheque physically changes hands.

Taxes and land registry

Payment of transfer tax (ITP) or VAT (IGIC for new builds) and registration of the new owners in the Spanish land registry (Registro de la Propiedad).

When buying an older property you pay transfer tax (ITP) of 6.5%. For new builds you pay local VAT IGIC at 7% plus stamp duty (AJD) of about 1%. Rental income for non-residents (EU citizens) is subject to 19% income tax. Our local gestores will help you with every tax filing and any optimisation.

We help you open your own Spanish bank account. You transfer the money from your Czech bank into your own name. The purchase price is settled with a guaranteed bank cheque issued by your Spanish bank, which is handed over to the seller in front of the notary at signing. You never send money to our agency.

After the notarial signing we take over the administration in full. We transfer water and electricity contracts and set up direct debit (domiciliación bancaria) for community of owners' fees from your new Spanish account. You don't have to deal with any forms.
